RULES FOR 2012 AHHA STALLION SERVICE AUCTION

The auction shall be governed by the following terms and conditions:

  1. Bidding opens on January 15, 2012 at  12:01 PM (EST).  Bidding will be accepted via on-line  bidding only.
  2. Bidding closes February 15, 2012, at 9:00 PM (EST).  Closing time is determined by the AHHA Auction Server time stamp.
  3. The minimum bid shall be Five Hundred Dollars ($500.00), unless otherwise noted.  The buyer agrees to pay to the stallion owner other expenses associated with breeding his/her mare, such as booking fees, per day mare care, shipping costs and/or any veterinary expenses, etc.  The buyer will contract with the stallion owner for all mare care costs and all veterinary expenses incurred during breeding.  Information pertaining to these fees is on the website, however IF THERE IS ANY QUESTION REGARDING THESE FEES, IT IS THE RESPONSIBILITY OF THE BIDDER TO CONTACT THE STALLION OWNER/AGENT PRIOR TO THE BIDDING.
  4. Bids may be increased or updated online.  The minimum increment for increasing bids is $25.  The software will bid incrementally on your behalf up to your maximum bid, which is kept secret from other users, if you elect to use the proxy bidding function.  Proxy bidding is optional.
  5. The stallion service fees being offered are for the 2012 breeding season.
  6. The buyer agrees that his/her mare must meet the stallion owner's approval and that his/her mare will conform to all health requirements of the stallion owner.
  7. All bids are binding.  AFTER THE CLOSE OF THE AUCTION, THE WINNING BIDDER WILL BE OBLIGATED TO THE ASSOCIATION FOR THE AMOUNT BID WHETHER OR NOT THE BID IS USED BY THE MARE OWNER.  Refunds will be made only in cases where the stallion dies or becomes unfit for service prior to servicing the mare. 
  8. PAYMENT MUST BE MADE TO THE AHHA AUCTION WITHIN TEN DAYS OF THE CLOSE OF THE AUCTION, EITHER BY CHECK, MONEY ORDER OR CREDIT CARD.  IN CASES WHERE PAYMENT IS NOT RECEIVED WITHIN TEN DAYS, THE BREEDING WILL GO TO THE NEXT HIGHEST BIDDER.
  9. Should a stallion die, become unfit for service or is sold prior to breeding the buyer's mare, the buyer shall contact the American Holsteiner Horse Association, Inc.  The AHHA will notify the stallion owner, and any money paid for the stud service will be refunded and shall constitute payment in full for any damage that may be incurred by the buyer or his/her agent.
  10. THE WINNING BIDDER AGREES TO ABIDE BY THE TERMS OF THE STALLION OWNER CONTRACT FOR THAT STALLION.
  11. The buyer agrees and acknowledges that he/she fully realizes that there is a possible danger of injury or death involved in the breeding of horses and the attendant care of the mare.  Buyer voluntarily assumes all risk of accident, injury or death to said mare and specifically releases the American Holsteiner Horse Association, Inc., its officers, employees and agents from all liability for any and all injury or disability suffered by or sickness or death of the mare in foal from any cause whatsoever, and specifically waives any and all claims resulting from such injury, disability, illness, or death.
  12. Buyer specifically acknowledges and understands that the American Holsteiner Horse Association, Inc., makes no warranties either expressed, implied or by any other means of interpretation in connection with this agreement.  It is expressly understood by the buyer that the American Holsteiner Horse Association, Inc., is acting as nothing more than selling agent of the stallion owner, and the stallion owner in turn has agreed to contribute the purchase price of the stallion service fee to the activities of the American Holsteiner Horse Association, Inc. (in U.S. funds).
  13. Registration of foals resulting from this breeding is subject to the established breeding and registration rules and regulations of the American Holsteiner Horse Association, Inc.
